What caused my child to develop cerebral palsy?

These are questions we are often asked by parents of children with cerebral palsy. They are questions rarely addressed by the child’s treating physicians. Answering these questions involves bringing together the medical opinions of a variety of different medical specialists who must each contribute their opinion on discrete areas of the medical care provided or the injury suffered by the child. Since this does not impact upon the medical treatment being provided to the child, this typically does not occur in the clinical setting.

This leaves many parents with unanswered questions. Over the years an exhausted parent’s battle for answers quickly becomes displaced by the daily battle for much needed support such as therapy and equipment. The unanswered questions, however, continue to weigh on the parent’s mind, resurfacing from time to time, only to be buried again by the weight of the day-to-day needs of their child.

Could it have been prevented?

It is understood that cerebral palsy can occur as a result of various medical conditions that are well-known and preventable with appropriate medical care. In these circumstances, your child may be entitled to receive significant financial compensation to allow the parents to provide for their child’s care, support and therapy, to help their child reach their full potential in life.

It is also understood that cerebral palsy can occur for reasons that are not (yet) understood by modern medicine and in circumstances in which it was not preventable. In these cases, knowing the child’s injury was no one’s fault can help relieve any anger or guilt parents may be feeling, and help them to put the circumstances of their child’s birth behind them, and to focus on their child’s future.

Either way, parents often feel it is better to know, rather than to continue to wonder.

Susanne Raab Recognized in the 2018 Canadian Legal Lexpert Directory

Susanne Raab has been selected as a leader in medical malpractice litigation by The Canadian Legal Lexpert® Directory. Susanne’s practice focuses on representing individuals and families who have suffered injuries as a result of medical malpractice, with a focus on birth injuries and catastrophic brain and spinal cord injuries. Susanne has appeared before the Supreme Court of BC, the BC Court of Appeal and the Supreme Court of Canada. Prior to joining Pacific Medical Law, Susanne represented physicians in complex medical malpractice actions.

Susanne is actively involved in advocating for individuals living with disabilities, and serves as the President of the Board of Directors as well as Chair of the Advisory Committee of the Cerebral Palsy Association of British Columbia.  She is also on the Board of Governors of the Trial Lawyers Association of BC which is committed to improving access to justice for all British Columbians. She is a member of BILA, the Birth Injury Lawyers Alliance and a Fellow of the Litigation Counsel of America, an honorary trial lawyer society whose membership is limited to less than one-half of one percent of North American lawyers, judges and scholars. Susanne is also an adjunct professor at the UBC Allard School of Law where she teaches the medical negligence course to 2nd and 3rd year law students.

Paul McGivern Recognized in the 2018 Canadian Legal Lexpert Directory

Paul McGivern has been selected as a leader in medical malpractice litigation by The Canadian Legal Lexpert® Directory. Paul is a senior litigator acting exclusively on behalf of plaintiffs in medical negligence cases, with an emphasis on complex catastrophic cases such as birth trauma, spinal cord and brain injury cases. He is frequently consulted by counsel throughout Canada for his expertise in this area. He has a unique background of 17 years as medical malpractice defence counsel and a reputation for understanding the medical and legal issues of complex malpractice actions. Paul has been lead counsel in hundreds of medical malpractice cases, has litigated legal precedent setting cases and has appeared as lead counsel before every level of court, including the Supreme Court of Canada (most recently in Ediger v. Johnston 2013 SCC 18 and Cojocaru v. British Columbia Women’s Hospital 2013 SCC 30).

In addition to being an advocate for the clients of Pacific Medical Law, Paul has been an adjunct legal professor at the University of British Columbia where he has taught civil procedure for 18 years. He is a sought after speaker and has organized and chaired a number of continuing education programs focusing on medical legal issues. Paul was a Director of the Medical Legal Society of B.C. and is a member of the Trial Lawyers Association of BC. In addition, Paul is a founding member of BILA, the Birth Injury Lawyers Alliance.

Paul McGivern speaks at the American Association for Justice 2018 Conference

Paul McGivern was invited to speak to the Canadian Caucus of the American Association for Justice at their conference in Denver, Colorado on July 7, 2018.  Paul provided the group with his approach to the initial intake and investigation of birth injury cases. He described the need to manage the risks inherent in these complicated cases by using a systematic approach that front-loads the necessary investigation and analysis.

Paul’s comments covered a range of topics, including the initial collection and review of records, retaining and instructing experts, and anticipating and preparing for defences that may be advanced.  Paul’s experience and expertise ensured that his talk was full of practical advice to assist lawyers in their management of these complex cases, and his insight and guidance were well-received by the members of the Canadian Caucus.

Susanne Raab again recognized by Best Lawyers™ in Canada for 2019

Pacific Medical Law is pleased to announce that Susanne Raab has once again been recognized as a leader in Medical Negligence law, through selection by her peers for inclusion in The Best Lawyers in Canada 2019.  Susanne is a Partner at Pacific Medical Law, and an advocate for people living with disabilities.

Susanne’s practice focuses on representing individuals and families who have suffered injuries as a result of medical malpractice, with a focus on birth injuries and catastrophic brain and spinal cord injuries. Prior to joining Pacific Medical Law, Susanne spent much of her legal career representing physicians in complex medical malpractice actions. This has given her unique insight into the potential risks and legal hurdles involved in medical malpractice actions. It also helps her to be proactive in overcoming or minimizing those risks.
