Pacific Medical Law obtained a settlement of over $6.4 million dollars for a baby who suffered a severe brain injury at birth as a result of the failure of the attending medical team to properly monitor the fetal wellbeing during labour and delivery. The baby was diagnosed with cerebral palsy.
The Public Guardian and Trustee recommended approval of the settlement to the court, noting that:
In our opinion, the result in this case could not have been achieved except by counsel with the skill and ability of Mr. McGivern. The ability of Mr. McGivern to persevere and establish liability and causation in a case such as this … is something most counsel would not be able to accomplish.
